Information for Retail customers with loans

Informare privind conditiile si efectele suspendarii platii ratelor la credite

Avand in vedere Ordonanta de urgenta nr. 37/2020 privind acordarea unor facilitati pentru creditele acordate de institutii de credit si institutii financiare nebancare anumitor categorii de debitori (denumita in cele ce urmeaza “Ordonanta”) prin care s-au luat masuri pentru combaterea efectelor negative ale pandemiei Covid-19, gasesti mai jos informatii privind conditiile si efectele aplicarii Ordonantei.

CONDITII DE APLICARE

Suspendarea platii ratelor se aplica in cazul creditelor de consum, creditelor ipotecare/imobiliare (inclusiv Pima Casa), descoperitului de cont si cardului de credit;

Daca indeplinesti conditiile de mai jos, poti beneficia o singura data amanarea platii ratelor, pentru o perioada cuprinsa intre o luna si noua luni, dar nu mai tarziu de data de 31.12.2020:

  • ai un credit in derulare, care nu a ajuns la maturitate si pentru care Banca nu a declarat scadenta anticipata, anterior datei de 30.03.2020;
  • la data de 16.03.2020 nu inregistrezi restante la creditele contractate la Garanti Bank SA sau deja ai efectuat plata restantelor, pana la data solicitarii suspendarii platii ratelor;
  • declari pe propria raspundere ca au fost afectate veniturile tale /ale familiei tale din cauza Covid-19, fata de nivelul inregistrat inainte de declararea starii de urgenta si te afli in imposibilitate de a onora obligatiile de plata aferente creditului, ca urmare a faptului ca tu sau un alt mebru al familiei*, va aflati in una din situatiile de mai jos:
  • Pierderea locului de munca din motive ce nu tin de persoana salariatului
  • Diminuarea veniturilor din salariu (si asimilate) urmare a:
  • Intrarii in concediu in baza Legii nr. 19/2020 privind acordarea unor zile libere parintilor pentru supravegherea copiilor, in situatia inchiderii temporare a unitatilor de invatamant;
  • Intrarii in carantina sau a izolarii la domiciliu in baza Ordinului Ministerului Sanatatii nr. 414/2020 privind instituirea masurii de carantina pentru persoanele aflate in situatia de urgenta de sanatate publica internationala determinata de infectia cu Covid -19 si stabilirea unor masuri in vederea prevenirii si limitarii efectelor epidemiei;
  • Intrarii in somaj tehnic urmare efectelor determinate de pandemia cu Covid -19;
  • Intrarii in somaj urmare efectelor determinate de pandemia cu Covid -19;
  • Imbolnavirii cu Covid -19;
  • Altor motive (suspendarea/diminuarea activitatii angajatorului, diminuarea timpului de munca, etc.)

*Se considera ca facand parte din membrii familiei, persoanele care au calitatea de sot/sotie, parinti si copii, care locuiesc si se gospodaresc impreuna cu debitorul.

EFECTELE SUSPENDARII PLATII RATELOR

Te rugam sa ai in vedere ca, in cazul aprobarii cererii tale,

  • perioada de creditare se va prelungi cu o perioada cel mult egala cu perioada aferenta numarului de rate amanate, doar daca se indeplinesc conditile referitoare la incadrarea in limita de varsta la terminarea contractului astfel prelungit; in cazul clientilor pentru care prelungirea maturitatii creditelor depaseste limita de varsta prevazuta in procedurile interne de acordare a creditelor, banca procedeaza la restructurarea creditelor cu incadrarea in limita de varsta;
  • pe perioada suspendarii platii ratelor se vor calcula dobanzi care vor fi percepute si platite dupa incetarea perioadei de amanare la plata a ratelor, astfel:
  • in maxim 60 de rate lunare egale, pentru creditele de nevoi personale cu garantii reale/creditele ipotecare/creditele imobiliare (inclusiv Prima Casa);

  • prin capitalizare la soldul creditului si impartirea pe toata durata creditului, pentru creditul de nevoi personale fara garantii, iar capitalul astfel majorat se plateste esalonat pana la noua maturitate a creditului, incepand cu luna imediat urmatoare expirarii perioadei de suspendare;

  • prin urmare, dupa incetarea perioadei se suspendare a platii ratelor, rata lunata va creste in comparatie cu situatia prezenta;
  • contractul de credit se va modifica de drept, prin efectul legii, fara incheierea de acte aditionale;

Mentionam ca, in cazul creditelor cu dobanda variabila, dobanda creditului, inclusiv dobanda amanata la plata, se va modifica urmare actualizarii indicelui de referinta.

Obligatia de a incheia polite de asigurare pentru imobilele aduse in garantie la creditele ipotecare/imobiliare (inclusiv Prima Casa) ramane valabila inclusiv pe durata suspendarii platii ratelor, in conditiile mentionate in contractul de credit.

Banca va raporta in evidentele Biroului de Credit comentariul “Suspendare la plata” la nivelul fiecarui cont pentru care a fost acceptata solicitarea de amanare la plata. Scorul de credit (FICO SCORE) nu va fi afectat de comentariul "Suspendare la plata", intrucat acesta nu influenteaza algoritmul de calcul. Suspendarea la plata este o informatie care face parte din categoria “Date referitoare la evenimente care apar in perioada de derulare a produsului de tip credit”, care poate fi prelucrata in Sistemul Biroului de Credit in baza interesului legitim. Inregistrarea suspendarii la plata este necesara atat pentru a reflecta in mod corect situatia creditului, in perioada suspendarii la plata, cat si pentru continuarea desfasurarii unei activitati de creditare responsabile, in conditiile protejarii, facilitarii accesului la creditare si prevenirii indatorarii excesive a persoanelor vizate, respectarii cadrului legal referitor la evaluarea bonitatii si la reducerea riscului de credit, precum si prevenirii utilizarii sistemului financiar-bancar pentru desfasurarea unor activitati contrare legii.

  • letric in agentiile Garanti BBVA al caror program il gasesti aici

Prezenta facilitate oferita conform OUG 37/2020 inlocuieste oferta comunicata anterior de Garanti BBVA privind acordarea unei perioade de gratie de pana la 3 luni pentru creditele cu garantie ipotecara si pentru creditele de consum fara garantie.

Avand in vedere numarul mare de solicitari primite in aceasta perioada, situatie generata de contextul economic si social actual, este posibil ca timpul de raspuns sa fie mai mare decat in conditii normale. Te asiguram insa ca analizam solicitarea ta si revenim imediat ce avem un raspuns.

Ultima zi de transmitere a cererii de suspendare a platii ratelor este 15 Iunie 2020.

We are managing the Internet and Mobile Banking services (Garanti BBVA Online and Mobile) in order for you to use them with priority, regardless of the type of banking operation required. We are kindly asking you to consider these banking channels as the first ones taken into account and, if you have not activated Internet Banking yet, you can do it easily at any Garanti BBVA ATM, if in proximity, by downloading the Garanti BBVA Mobile application in advance. This option is available only for the Retail customers.

Security measures

In order to avoid becoming victims of COVID-19 digital drifts, there are a number of actions that minimize your exposure to viruses:

  • Be suspicious of alarmist messages or links and attachments from unknown senders;
  • Remember that you contact customer service first;
  • Avoid the use of links and power typing addresses over the internet;
  • Install an antivirus on your devices;
  • Update all software and applications, including antivirus, to the latest version;
  • Avoid contributing to the disinformation of society and check the news from various sources before sharing it.

Additional useful information

Via our multifunctional ATMs you have access to cash for withdrawals. Please keep in mind the recommended distance of at least 2 m to be kept from any person around you or in line.

We encourage you to choose, with priority, the card payments, instead of cash, by using our Bonus Cards and Bonus Debit Cards.

Please try to avoid visiting the Branches in this period, unless it is absolutely necessary and you cannot solve your specific banking needs through the digital channels.

When coming to the agencies:

  • Please do not enter inside in case there are already more than 5 persons in the Branch;
  • Keep a distance of at least 2 m from other persons around you.
